FIre isn't taken, you can have it, if a gym leader/mod/admin can test you and passes you. You don't need to win, just have to do good. The battle has to be with your fire team.

On account of the fact that you haven't gotten a single badge yet, uh.. good luck.

However, Pikachu, I've just confirmed with Kisame; beating the E4 doesn't give you the opportunity to boot somebody else out of a gym.
